By downloading, installing, or using the Stymie mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Stymie is operated by Stymie Technologies LLC, a North Carolina limited liability company ("Stymie," "we," "us," or "our").
You must be at least 17 years of age to use Stymie. By using the App you represent and warrant that you are 17 years of age or older. If you are under 17, you may not use the App.
You must have the legal capacity to enter into a binding agreement in your jurisdiction to use the App.
Stymie is a score-tracking and social ledger application designed for recreational golf groups. The App allows users to record golf scores, track informal side game results, maintain a running season ledger, and share payment convenience links to facilitate direct settlement between players.
Stymie is a recordkeeping and score-tracking tool, not a gambling platform. The App records informal wagering arrangements between consenting adult friends for personal, recreational use.
Stymie does not facilitate, process, broker, or intermediate any financial transaction. Stymie does not hold, transfer, escrow, or guarantee any funds. Stymie does not operate as a gambling operator, bookmaker, or payment processor. Stymie does not verify, enforce, or guarantee any payment between users.
All financial settlements between users occur entirely independently of the App, directly between individuals. Stymie's role is limited to recording what users report to the App.
Users are solely responsible for ensuring that their use of the App complies with all applicable local, state, and federal laws, including any laws governing informal wagering in their jurisdiction. Stymie makes no representation that informal wagering among friends is legal in your jurisdiction and accepts no liability for any legal consequences arising from your use of the App.
You must create an account to use Stymie. You agree to provide accurate information during registration and to keep your account information current.
You are responsible for maintaining the security of your account. You agree to notify us immediately at privacy@stymiecrew.golf if you believe your account has been compromised.
You may not create multiple accounts. You may not use another person's account without their permission.
You agree not to use the App to violate any applicable law or regulation, harass or harm other users, post false or fraudulent information, attempt to gain unauthorized access to the App or its infrastructure, reverse engineer or decompile the App, use the App for commercial purposes without our prior written consent, or impersonate any person or entity.
The App allows group organizers to add guest players by name, without requiring those guests to have an account. By adding a guest player, you represent that you have the guest's consent to record their scores and wager results within the App. You are responsible for ensuring guests are aware their information is being recorded.
The App allows users to optionally provide Venmo usernames and Cash App cashtags to facilitate convenient linking to third-party payment applications. By providing a payment handle you confirm you own or have authorization to use that handle, consent to that handle being visible to members of your golf groups for the purpose of settling informal wagers, and acknowledge that Stymie has no control over and bears no responsibility for any transaction that occurs within Venmo, Cash App, or any other third-party payment service.
Payment handles are optional and may be added, edited, or removed at any time from your profile.
Certain features of the App are available at no charge, including joining groups, playing in rounds, and participating in Skins, Nassau, and Stroke Play games.
Certain premium features require a paid subscription ("Stymie Pro"), currently priced at $4.99/month or $49.99/year. Subscription pricing is subject to change with notice.
Subscriptions are billed through the Apple App Store or Google Play Store. All billing, refunds, and subscription management are handled by the applicable app store. We do not process payments directly.
You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods.
The App, including its design, code, graphics, and content, is owned by Stymie Technologies LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of the content you enter into the App. By entering content you grant Stymie a limited license to store and display that content to members of your golf groups as necessary to provide the service.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. STYMIE TECHNOLOGIES LLC EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted or error-free, that any scores, payouts, or ledger calculations are accurate or complete, or that the App will be available at any particular time. You use the App at your own risk. All scores, payout calculations, and ledger entries should be independently verified by the players involved before any financial settlement occurs.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STYMIE TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING ANY FINANCIAL LOSS ARISING FROM RELIANCE ON APP CALCULATIONS, ANY DISPUTE BETWEEN USERS REGARDING PAYMENTS OR WAGER OUTCOMES, ANY LOSS OF DATA, OR ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Stymie Technologies LLC and its members, officers, employees, and agents from any claim, liability, loss, or expense (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, your violation of any applicable law, or any dispute between you and another user regarding payments or wager outcomes.
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time from your profile screen. Upon termination, your right to use the App ceases immediately.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration in North Carolina under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement or unauthorized access claims. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms at stymiecrew.golf/terms and updating the date above. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
